Terms of Service
These Terms of Service ("Terms") are a contract between you and Prism ("Prism", "we", "us") and govern your use of the Prism platform at prism-builder.com and related services (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
Please also read our Privacy Policy and Acceptable Use Policy, which are part of these Terms.

Eligibility
You must be at least 18 years old to use the Service. By using it you confirm that you are 18 or older and that you have the legal capacity to enter into these Terms. The Service is intended for adults and is not available to anyone under 18.

Your account
You access the Service by signing in through Fanvue. You are responsible for your account, for activity that happens under it, and for keeping your access secure. Your use of Fanvue is governed by Fanvue's own terms; nothing here changes your agreement with Fanvue. You must provide accurate information and keep it up to date.

The Service
Prism lets you create AI characters and generate images and other media, spend credits on those generations, manage the content you create, and optionally publish or share it and connect third-party channels. We may add, change, or remove features over time.

Acceptable use
You must use the Service in line with our Acceptable Use Policy. Among other things, you must not use the Service to create or distribute illegal content, sexual content involving minors, non-consensual intimate imagery, or content that depicts a real, identifiable person without the rights and consents required. We may remove content and suspend or terminate accounts that violate these Terms or the Acceptable Use Policy.

Your content and ownership
Your inputs and outputs. "Your Content" means the characters, prompts, uploads, and generated outputs associated with your account. As between you and Prism, you retain the rights you hold in Your Content. You are responsible for Your Content and for ensuring you have the rights needed to create and use it, including rights in anything you upload.
Licence to us. You grant Prism a worldwide, non-exclusive licence to host, store, process, transmit, display, and create technical copies of Your Content solely to operate, secure, and improve the Service and to provide the features you use (including sending inputs to the AI providers that generate your content, and displaying content you choose to publish or share). This licence ends when you delete the content or close your account, except for copies retained as described in the Privacy Policy or required by law, and except for content you made public that others may have saved.
AI-generated output. Generated output is produced by AI models from your inputs. Because of how generative models work, outputs may be similar to those produced for other users, may not be unique, and may not be eligible for certain intellectual property protection. You are responsible for reviewing outputs before you use, publish, or distribute them. As between you and Prism, and to the fullest extent permitted by law, you own the outputs you generate and may use them for your creator content.
Training and improvement. We use some prompts and images to train and improve the Service (for example, adding to our retrieval/vector store so results improve over time). Before any such use, we remove physical and identifying attributes, so the data used for improvement is de-identified.

Publishing and sharing
If you publish content to Explore or create a share link, you allow us to display that content to other users (Explore) or to anyone with the link (share pages), attributed to your AI character and never to your personal identity. You can unpublish content at any time, though copies may persist where others have already saved or cached it. Do not publish or share content you do not have the right to distribute.
When you publish to Explore, other users can see your content and may copy its prompt to use for their own characters. Consider this before you publish: once you publish a prompt, you should not expect to keep any exclusive claim over others reusing it. Only publish content and prompts you are comfortable with others seeing and reusing.

Credits and billing
Credits. Generations and certain features are paid for with credits. Credits are purchased through Fanvue, either via a Fanvue subscription or one-off Fanvue checkout links.
How credits are spent. Credits are consumed when you run generations and use paid features. Some generations reserve an estimated amount and then settle to the actual cost, releasing any difference. Prices and credit costs may change; we will make current pricing available in the Service.
Refunds. Refunds are handled through Fanvue in line with Fanvue's refund process. For any refund enquiries, contact us at team@prism-builder.com.
Taxes. Taxes are handled by Fanvue as part of the subscription or checkout process.

Third-party services
The Service integrates third-party providers (for example AI model providers and connected channels such as Telegram, Discord, and Google Drive). Your use of those integrations may also be subject to the third party's terms, and we are not responsible for third-party services. See the Privacy Policy for how data is shared with providers.

Privacy and data
How we collect, use, and share your personal data — including cookies, product analytics, and the Accept/Reject choice you control over analytics — is set out in our Privacy Policy, which forms part of these Terms. By using the Service you agree to the handling of your data described there.

Service availability
We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may modify, suspend, or discontinue any part of the Service, and we may perform maintenance, at any time. Features may be offered in beta and may change or be withdrawn.
To be clear, you are paying for credits, which you consume on generations and features, not for the Service itself or for any guaranteed level of availability. We do not provide uptime or service-level guarantees for standard use. Any service-level commitments (SLAs) apply only to specific users on an enterprise plan where separately agreed in writing.

Suspension and termination
You may stop using the Service and request account closure at any time. We may suspend or terminate your access if you breach these Terms or the Acceptable Use Policy, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; the sections that by their nature should survive (including content licence for retained copies, disclaimers, limitation of liability, and indemnity) will survive. Unused credits are non-refundable on termination, except where required by law or handled through Fanvue's refund process.

Disclaimers
The Service and all content and outputs are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not warrant that outputs will be accurate, appropriate, unique, or suitable for any purpose, and you are responsible for how you use them.

Limitation of liability
To the fullest extent permitted by law, Prism will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the total amount you paid for Prism credits in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

Indemnification
You agree to indemnify and hold harmless Prism from claims, damages, and costs (including reasonable legal fees) arising out of Your Content or your breach of these Terms or the Acceptable Use Policy, to the extent permitted by law.

Changes to these Terms
We may update these Terms from time to time. We will post the updated version and update the "Last updated" date, and we will provide additional notice for material changes where required. Continued use after changes take effect means you accept the updated Terms.

Governing law and disputes
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory consumer protections that apply in your country of residence.
